The applicant Murtajarr Pushank Sahu, father Vedprakash Sahu, age 26 years, Amatalab Road Dhamtari, came to the police station on 15.04.25 and filed a written report that on 14.04.25, he had come to Bhakhara with his brother Himanshu Sahu and friend Lekhraj Dhruv to do a photoshoot at the wedding ceremony of Tevendra Sahu, resident of village Surra. At around 11:30 pm, the applicant parked his car at Ramlila Maidan Bhakhara and was coming towards the main road with a camera. At the same time, Bhishma alias Chotu Mal, resident of Bhakhara, came with his companions and saying “you people are baraatis”, abused his mother and sister and threatened to kill him.
He caught the collar of the applicant and beat him with punches. His companion beat him with a beer bottle and a sharp knife and injured him. On the complaint of the applicant, FIR No. 50/25 under Section 296 IPC was registered at Police Station Bhakhara and investigation was taken up under Section 115(2), 351(2), 3(5) IPC. The applicant Murtazar was immediately taken into investigation and on the basis of his statement, the accused Bhishma Kumar alias Chhotu Mal and Gulshan Garg, Naveen alias Sameer Nirmalkar and another, all residents of Bhakhara, were arrested and on interrogation, they told that Naveen alias Sameer Nirmalkar hit the applicant near the ear with a beer bottle in his hand and the struggling boy took out a sharp knife kept with him and while waving and shouting, stabbed Himanshu’s brother in the back. Seeing this, the applicant pulled his brother and in anger the struggling boy stabbed the applicant with a knife on the elbow of his left hand and injured him. Lekhraj Dhruv and Lalit Sahu intervened and saved him.
Both the injured brothers were taken to the hospital for treatment. On the basis of the doctor’s report, Section 118(1) IPC was added to the case.On questioning the accused and the child in conflict, they confessed to the crime. In their memorandum statement, accused Naveen alias Sameer Kumar Nirmalkar, Bhishma Sahu and the child in conflict stated that the attack was made with a beer bottle and the child in conflict with law attacked with a sharp knife. The knife used in the incident was seized from the accused in the presence of witnesses and Sections 25, 27 Arms Act were added to the case. On the basis of the statement of the applicant/Murtazarar and witnesses, sufficient evidence was found against the accused and the child in conflict with law.
